Rules and conditions

Every user of codepearls.com must agree to the terms of service stated on this page. Any disagreements will terminate all services, use, or consultation by codepearls.com to the disagreeing party.

Revision Policy

We provide revisions depending on the package you have chosen. Customers can enjoy unlimited free revisions when we edit their website without any additional charges, provided the theme and layout remain the same. Processing time for revisions is 24-48 hours.

Turnaround Time

Code Pearls has a turnaround time of 24-48  hours for most web development services. Please note that this is not a complete project timeframe. It is only the turnaround time for one iteration of the development phase. Time of delivery depends on the type of service, which nonetheless should not take less than 48 hours or 72 hours, equivalent to two business days.

Moreover, we understand that weekends are for leisure and do not form part of working days. Thus, weekends do not count as workdays on the days we commit. For example, if the commitment time frame is 2 weeks, this counts as 14 working days excluding weekends. Similarly, in a 4-week time frame, it is considered as 28 working days excluding weekends. Therefore, weekends will not be counted as working days in our committed dates. For example, if the commitment timeline is 2 weeks, this will be treated as 14 working days without weekends. Similarly, for a 4-week timeline, it will be treated as 28 business days without weekends.

Examples:

Website orders or revisions requested on Monday will be delivered by Wednesday.
Website orders or revisions requested on Friday will be delivered by the end of the day on Tuesday.

Refund Policy and Money Back Guarantee

In no event will any project funds be refunded after delivery if the services are approved or if a change is requested unless Code Pearls cancels or terminates your contract for any reason.

All refund requests will be processed as follows:

You can make a request when initial site designs are offered. However, once you have approved or requested changes to the original layout, the refund offer will become void and the refund request will not be accepted.
If you request a refund before submitting the original plan, you are entitled to a full refund (excluding 10% processing and processing fees).
If you request a refund within 48 hours, you are entitled to a 66% refund (less a 10% service handling fee).
If a refund is requested within 48-120 hours between 48-120 hours from receipt of the original offer, you are entitled to a 33% refund (minus 10%) for payment for service processing.
No refund will be claimed after a hundred and twenty hours from the first notification being given. On the other hand, since our firm will guarantee the satisfaction of 100% of its clients with the services offered, it is advisable to get in touch with us in case of any issue during this period.
However, when it comes to cancelation, returns, and exchanges, this company will not entertain any such request after the order has been processed in the first 30 days of an order being placed. Where the administration is to rest for the continuation of site order they shall be allowed to rest on after charging a fixed fee for the amount of projects.
No refund requests will be processed once the final files have been delivered.
If the client requests a refund during the project due to a change of heart or any other personal issues, then the client is not entitled to a refund, although we may store credit in the amount that can be used for another service later.
For website packages, no replacement will be deployed after website development is completed or the website is
Refunds are processed for orders placed in good faith. If a customer has placed web orders with more than one web agency for the same order with the intention of requesting a refund, we do not consider this to be in good faith. In this case, we reserve the right to refuse a refund request.
All refund requests should be sent to the support department. Code Pearls reserves the right to approve/disapprove your request on an individual basis based on your violation of the User Agreement.
A refund request must have a valid reason to support it, which must be consistent with the site’s brief description and customer feedback for revisions. If the layout is not designed as shown, the refund will not be processed; however, further revisions will be provided until complete satisfaction.
All web jobs require customer feedback before design and development are complete; therefore, it is only fair for the customer to be involved and provide feedback to achieve the desired results.
100% Unique Website Guarantee entitles you to a re-draw if our developed website is found to be significantly similar to another website that may already exist. Any similarity to existing websites will be purely coincidental and Code Pearls will not accept any responsibility or claim compensation in such event. It is the client’s responsibility to ensure that their website is protected by copyright.
Note: Code Pearls has all rights to reject any project or cancel the contract whenever it deems necessary. After the refund, you will have no rights to use the domain for any purpose; will be the sole property of Code Pearls . The Company will be the rightful owner of the Website.

Services not related to website services

Services not associated with the Website Services are not entitled to a refund under any circumstances. They are not covered by our 100% refund. If such a service is purchased as part of any package offer, it is not redeemable for the entire package.

For services not covered by the 100% refund policy, in case of dissatisfaction, Code Pearls management may decide to offer a partial refund to the client after reviewing the project.

How to claim a refund

In order for your refund request to be approved, please ensure that you meet the following requirements:

We will try to resolve your issue immediately based on our revisions policy, or we will email you a refund approval from our refund department. After the refund, the copyright of your website would be acquired by Code Pearls and you would not be able to use the website design sent by the company. Let us also clarify that:

Since the rights to the Website will now be transferred to the Company, you agree that you will have no right (direct or indirect) to use, or have any ownership interest in, any Response or other content, work product or media.
In cooperation with government copyright agencies, Code Pearls would share copyright acquisition information for returned designs, which would limit future reuse of the site as its original layout.

Communication policy

Emails sent back and forth through the official email that are “contact@codepearls.com” should only be considered forms of valid communication. We are not responsible for any damages, problems or delays caused by contacts made through means of communication that we do not provide. We take full responsibility for all information provided through our official domains.

Principles of quality assurance

Code Pearls will do their best to meet your requirements and our web developers will do their best to meet your expectations. We believe in providing the best websites and each of our layouts is well crafted.

Our unlimited revisions policy is to ensure you are 100% satisfied. Our goal is to exceed your expectations and strive to meet them. We will not stop our revisions until you are completely satisfied with your website (the number of revisions will depend on your package).

Delivery Policy

The complete order will be sent to the specified account on the day indicated on the Order Confirmation and a confirmation email will be sent at the same time. The turnaround time will be according to the package; the minimum required time is two working days. The website will be operational only after payment of all fees. The website will not be launched under any circumstances if there are any unpaid charges. In case of an urgent or rushed order, please contact our customer support team.

Website Ownership and Rights

All completed websites provided by Code Pearls are done based on the client’s written request for completion and upon completion the client receives all credentials and owns 100% of all ownership rights to said website.

The client will own the final website design provided by Code Pearls in its entirety.

All ownership rights to said completed website shall belong 100% to the client.

The Client is free to use the completed website as it sees fit.

However, the Client may not own any materials, media, or other content created during the revision cycles leading to the final product.

Content creation and population

Code Pearls will not be responsible for creating or embedding content (e.g. text/images) on the Website unless specifically purchased otherwise. In which case:
Code Pearls will fill the website with content created for the client.
Website content/text will be created specifically for the customer’s website.
Code Pearls fills the web with images.
Code Pearls acquires stock images from stock photography websites for the client.
Images will be purchased upon client approval.
Code Pearls will fill the website with products and product details.
Product images and product details will be provided by the client.

N.D.A. & Reputation Management Principles

Code Pearls does not share customer information regarding their project or contact details with anyone. The client’s personal and project information is confidential at all points. Once the project is successfully completed, both parties, Code Pearls and the Client, agree not to intentionally defame or otherwise disparage the other party with respect to matters arising after the completion of the project. Once the Project is successfully completed, each party agrees to refrain from (and Code Pearls will take reasonable steps to cause its officers and directors to refrain) directly or indirectly making any further defamatory comments of any type or nature against to anyone about the Client (and in the case of the Company, its employees, executives, directors, representatives, consultants, affiliates, investors or business partners).

Maintenance of records

Code Pearls maintains records of the delivery of final products and communications.

Customer support

Our customer support team is available on Monday to Saturday 9:00 am to 7:00 pm GMT to answer all your concerns and questions over whatsapp. All other after-hours inquiries must be emailed by the customer via the Team Works Account section and will be picked up the next business day.

Technical Support Policy

Code Pearls is primarily a web service.  We will design and develop the services that the client needs. Our purchased packages and services will occasionally include technical aspects to help the client with their website and email. Code Pearls will provide the Client with basic information regarding these Services and the settings required for these Services to work. Code Pearls will not be responsible for providing detailed training or installation of said services at the customer end.

It is important for the Client to note that Code Pearls does not offer a standard SLA for technical support or business service outage without prior agreement, for a subscription-based maintenance plan.
Email Setup: Code Pearls will provide the customer with the necessary setup and information to install the emails at their end. Code Pearls is not responsible for the installation of said emails on the customer side. Code Pearls is not responsible for providing technical support or troubleshooting assistance when using email, as all our emails are on open servers and are accessible to all service providers. Code Pearls shall not be in any way responsible for the failure of the customer to perform, install or learn to use the above services on their end as the responsibility for the same lies on the end of the customer.

Email and Mobile Phone Policy

This policy describes the terms and conditions regarding the use of email and mobile contact information provided to Code Pearls.

Consent and Use: By providing your email address and/or mobile phone number, you agree to receive communications from Code Pearls. This includes interim messages, regular updates about your service or project, updates, and service delivery such as proposal attachments, project updates, and revision updates.
Carrier Charge Disclosure: Standard message and data rates may apply. Please contact your mobile operator for details.
Information Security: Your email address and mobile phone number will be kept confidential and not shared with third parties without your express consent, except as required by law.
Policy Changes: Code Pearls reserves the right to modify this policy at any time. Any changes will be posted on our website and it is your responsibility to review these changes.
